Peacefulmountain homestay & Tours Terms And Conditions

These terms and conditions are applied for the booking of bus tickets, tour package as a tour company. By making the payment you accept these terms and conditions. In these Terms & Conditions, the word “Customer” means the person who agrees to buy and/or any person on whose behalf you agree to purchase the package tours, day trips and other travel services provided by us.

**Tour route, itineary, stays and buses are all subject to change**

PRICES

All rates shown on the website for bus tickets is quoted in US dollars.

We reserve the right to vary prices and rates in the event of changes in exchange rates or price rises made by us or other suppliers. If the cost of any service increases due to exchange rate fluctuations, price increases, tax changes or any other reason, you are required to pay the increase when notified by us or you may cancel the booking which may result in cancellation fees. We are not liable in any way if any increase occurs. Rates quoted are appropriate to the particular product at the time of quoting and these rates may change prior to the travel date. All prices are subject to availability and can be withdrawn or varied without notice.

DEPOSIT

Tour Deposit:
To secure your reservation and allow us to prepare services thoughtfully, a non-refundable deposit of 50 USD per person is required upon confirmation of your tour booking. This deposit will be deducted from the total tour cost.

Non-Refundable Policy:
The deposit is non-refundable under any circumstances in case of tour cancellation by the customer. This is to cover the costs of advance service arrangements (transportation, accommodation, meals, entrance fees, etc.) and to ensure commitment throughout the tour organization process.

CONFIRMATION BY US

An ORDER confirmation email will be sent to customer’s provided email address within 24h after the payment is successful. We will send you an email for instuction about the Bus Timing, Start date, Pick up point as close to customer’s Start Date.

Our reservation is completed once the ORDER confirmation email is sent to the email address you provided. You are required to notify us via email in case of you do not receive the ORDER confirmation in time, if no email informing us that you do not receive the confirmation email within 2 days, the service is understood to be completed.

We are not responsible for any delay/loss caused by the wrong email addresses or wrong Whatsapp Number provided by customers or the situation that customers do not notify us by email that confirmation is not received or in case of customer refuses to use booked service.

REFUND OF UNUSED SERVICES

No refunds or exchanges can be made in respect of services which are included in the price but not utilized by the customer, such as there will be no refund given for any unused or missed ground arrangements, sightseeing, meals or hotel accommodations. For no-show cases full amount will be charged.

ACCEPTANCE OF BOOKING

We reserve the right to decline your booking without explanation if we have cause to believe that you might pose a threat to public safety or security in Vietnam. We reserve the right to adjust the itinerary or to substitute hotels or to cancel a tour prior to departure without prior notice or will take no responsibility for any loss due to group dynamics, weather condition, governmental or police action, traffic jam or other conditions dictate. We require you to take out travel insurance and any other necessary insurances adequate to meet your needs and will assume that you will have done so before your arrival in Vietnam.

CANCELLATION

Cancellation by customers:

All cancellations must be received in writing, sent to us via WhatsApp or email. If you book the tour with us via Website and want to cancel

If you cancel within 7 days of the tour start date: we can only help you to change the date for your booking

There will be no refund given for any unused or missed ground arrangements, sightseeing, meals or hotel accommodations. For no-show cases full amount will be charged.

VISA ISSUES:

It is the sole responsibility of the participant to obtain the necessary visa to attend the event/service. Peacefull Mountain Homestay & Tours will not be held responsible for any participant’s inability to obtain a visa for any reason, including but not limited to delays in visa processing, visa denials, or any other visa-related issues. The Company does not offer refunds or credits for participants who are unable to attend the event/service due to Flight cancel or Visa issues.
Cancellation by us: In the unlikely event that such circumstances should arise we will contact you immediately and offer you the choice of an alternative of equivalent quality or a full refund of all money paid. No additional compensation will be paid over and above the total sum received from you. We reserve the right to cancel the contract between us for any reasons to your payment of the deposit the tour.

FORCE MAJEURE

If as a consequence of “Force Majeure” (as defined below), We are obliged to curtail, alter, extend or cancel the Tour, you shall not be at liberty to maintain a claim for compensation or otherwise for any loss arising as a consequence of said curtailment, alteration, extension or cancellation of the Tour. “Force Majeure” means Acts of God, natural disasters, adverse weather conditions, fire or other destruction of any vessel, craft or vehicle to be used in connection with a holiday, destruction or damage to holiday accommodation, riots, acts of war, civil commotion, exercise of legislative or government action, municipal or military or other authority, strikes, industrial action, requisition of equipment, mechanical breakdown, shortage of fuel, insolvency or default of any carrier or service connected with the Tour, fraud perpetrated against Vietnam.

TRAVEL DOCUMENTATIONS

All Customers must be in possession of a valid passport and necessary visas or permits at the commencement of travel. All such documentation is the sole responsibility of the client. We accept no responsibility or liability whatsoever for the failure of clients to obtain appropriate documentation.

INSURANCE

Since Bus tickets, boat tickets are exclusive of insurance, you are required to obtain your own full travel insurance. It is your responsibility to read your insurance policy before you travel and ensure that the insurance scheme provides you with the requisite level of cover.

LIABILITY

We are not responsible for any loss, injury or damage sustained by Customers. Additional expenses incurred due to delays, accidents, natural disaster, political actions and unrest must be borne by Customers.

DIETARY REQUIREMENTS

Whilst every effort is made to ensure the food provided fits your dietary requirements, it is the responsibility of the customer to ensure all food fits this criteria.

CLAIMS

All disputes, claims, and litigation regarding the Services shall first be settled by way of discussion and mutual understanding. In case such negotiation and agreement might neglect, the disputes, claim, or litigation shall be finally resolved by the mediation of the Vietnam International Arbitration Centre (VIAC) at the Chamber of Commerce and Industry of the Socialist Republic of Vietnam. All claims must be submitted in writing within 30 days after the end of this Services.

LUGGAGE STORAGE

Peaceful Mountain Homestay & Tour offers Luggage storage for the duration of your tour only. Further storage will require payment as discussed with tour owners. It is the sole responsibility of the customer to ensure their bags are clearly labelled before being stored. For higher value items (laptop, … e.t.c.) a safe is available and should be used where possible. Please note we do not store any forms of currency. It is the customers sole responsibility to check their luggage upon return and inform tour owners of any missing items immediately. Any items left behind in the dorms/homestay is the responsibility of the customer. The tour owner will try to locate any missing items but are not held responsible if not found.

ACCOMMODATIONS

To ensure security and to comply with local government regulations, you must adhere to the following rules: – Upon arrival, you will need to show a form of identification (foreign visitors will need to show passport and visa.) – It is strictly forbidden to bring any weapons, drugs, explosives or any illegal items onto any premise provided by the tour owners, including but not limited to any homestay that is provided, the resturants and the attractions. – No gambling of any kind is allowed. – No smoking in the house or bedroom

Customers who self-drive
1. Customers who wish to drive themselves must be able to drive safely, if a customer looks like they pose a threat to themselves or others Peaceful Mountain Homestay & Tours will have to change their tour into the easy rider option, (all expenses for that change will be on the customer)
2. Customers will have to safely keep up with the speed of the group, if they are unable to then they will have to change to either a private tour or an easy rider option (all expenses for the the change will be on the customer)
3. Any and all damage done to the motorbike will have to be paid for by the customer.
Purchasing this tour I hereby agree to the following terms and conditions in exchange for participation in the motorcycle tour provided by Peaceful Mountain Homestay & Tours. *Assumption of Risk*: I am aware that participating in a motorcycle tour involves inherent risks, including but not limited to risks from operating a motor vehicle on public roads, adverse weather conditions, actions of other participants, and actions of our drivers. I voluntarily choose to participate in this tour and acknowledge these risks. *Release of Liability*: I hereby agree to release and discharge [Peaceful Mountain Homestay & Tours], its officers, employees, agents, and affiliates from any and all liability, claims, demands, actions, or causes of action arising out of my participation in the motorcycle tour. This release includes, but is not limited to, liability for personal injury, property damage, or wrongful death. *Indemnification*: I agree to indemnify and hold harmless [Peaceful Mountain Homestay & Tours] from any liability, claims, demands, actions, or causes of action brought by third parties arising out of my participation in the motorcycle tour. *Acknowledgement*: I acknowledge that I have carefully read this waiver and release of liability and fully understand its contents. I voluntarily agree to its terms of my own free will
